This is a legally binding written agreement between the client and the life coach. Clients are urged to take their time and review the entire document. Clients also are encouraged to ask questions, as well as to consult with an attorney prior to signing.

Definition of Life Coaching

One way life coaching may be defined is a method of instruction where the life coach assists a person in identifying and attaining (achieving) specific goals. These goals can be personal and/or professional (APA, 2018).

Nothing Should Be Interpreted as Medical or Pharmacy Advice

Nothing that is discussed between the client and the life coach should be interpreted as medical or pharmacy advice.

Nothing Should Be Interpreted as Legal Advice

Nothing that is discussed between the client and the life coach should be interpreted as legal advice.

Medical/Mental Health/Counseling/Pharmacy/General Healthcare Services are Not Provided

As previously stated, nothing that is discussed between the client and the life coach should be interpreted as medical, pharmacy or legal advice. Furthermore, mental health services are not provided by Positivity Inspires, LLC or by Temeka Borden, and nothing discussed between the client and the life coach should be interpreted as mental health advice. Please consult with your healthcare provider or an attorney regarding any healthcare or legal, respectively, needs.

The Client Should Consult with Professionals/Experts in Their Respective Fields Regarding Any and All Matters That May Be Brought Up by the Client During a Discussion

In all matters, the client should consult with a professional/expert in the respective field (e.g., medical, legal, financial, et cetera) – one who is not affiliated with Positivity Inspires, LLC/Temeka Borden. Please note Temeka Borden is not an attorney or a lawyer, and she has never worked and currently does not work in the legal or law enforcement field. Furthermore, Temeka is not a physician, mental healthcare professional, counselor, or financial professional, and she does not provide medical, mental health, pharmacy, or any other healthcare-related advice or services, legal advice or services, or financial advice or services to her clients. Neither does Temeka Borden diagnose, treat, or monitor any health/mental health conditions.

Please be advised that coaching services provided by Positivity Inspires, LLC/Temeka Borden are not a substitute for any care/services that should be provided by professionals/experts who are licensed and who are practicing in the appropriate fields, as described in this section and in previous sections of this agreement.

Some Incidents Discussed between the Client and the Life Coach May Be Reportable

All efforts to maintain client confidentiality will be made. However, in some instances, incidents that may be considered reportable, if communicated to the life coach, may be reported by the life coach to the appropriate departments/agencies if necessary. This includes law enforcement agencies.

No Liability

It is the client’s responsibility to be an active participant and to establish his/her/their goals, and it is the client who is responsible for his/her/their outcomes. The life coach makes no guarantees regarding clients’ outcomes, and in no event shall the life coach be responsible in any way for any adverse outcomes, including financial ones. Roles and Responsibilities (Client and Coach)

Please note it is the coach’s responsibility to provide guidance in an effort to better position the client to attain his/her/their goals. It is the client’s responsibility to be an active participant and to establish his/her/their goals, and it is the client who is responsible for his/her/their outcomes. The life coach makes no guarantees regarding clients’ outcomes, and in no event shall the life coach be responsible in any way for any adverse outcomes, including financial ones.

Coaching Materials

All rights to coaching materials developed by Positivity Inspires, LLC/Temeka Borden remain with Positivity Inspires, LLC/Temeka Borden. The client may use them for their personal use only.

Subscribers Only - Coaching sessions, duration, channels, fees and payments

The client agrees to attend all sessions, totaling 3 sessions per month, with a duration of 30 minutes per session. All sessions will be done via online video conference / telephone only and on a weekly basis. The cost for all 3 each sessions will be $59.99, with the cost for each session equaling approximately $19.99. Note that weekly blogs are added to the monthly plan for free when the client becomes a subscriber.

Positivity Inspires, LLC accepts several forms of payment. Payment will be required prior to coaching sessions. A late fee may be charged for each payment that is not made on time. (Exceptions will be made due to extenuating circumstances and/or according to the business owner’s discretion.)

Non-Subscribers Only - Coaching sessions, duration, channels, fees and payments

The client agrees to attend the life coaching session with a duration of 30 minutes or 1 hour per session (dependent upon what was booked by the client). All sessions will be done via online video conference / telephone only. The cost for a 30 minute or 1-hour session will be $29.99 or $49.99, respectively.

Positivity Inspires, LLC accepts several forms of payment. Payment will be required prior to each session. A late fee may be charged for each payment that is not made on time. (Exceptions will be made due to extenuating circumstances and/or according to the business owner’s discretion.)

An Appointment Cancellation Fee May Be Charged

It is understood that unforeseeable events may occur and that the client may need to cancel a booked appointment. Positivity Inspires, LLC asks that if an appointment must be canceled, the client does so at least 24 hours before the scheduled appointment. If that specific timeframe is not met, a cancellation fee equaling 25% of the booked service price may be charged. (Please note that exceptions will be made based on extenuating circumstances and/or according to the business owner’s discretion.) Rescheduling an appointment as soon as possible is strongly encouraged.

Cancellation of Coaching Services

Either party (i.e., the client or Positivity Inspires, LLC/Temeka Borden) may cancel the Positivity Inspires, LLC monthly life coaching services plan at any time and for any reason. Please also note this business’s Anti-Discrimination Policy.  Please allow 7 to 10 business days for processing.

If the client chooses to cancel the monthly plan, and depending on the circumstances, a termination fee equal of up to 50% of any outstanding balance may be charged. If Positivity Inspires, LLC / Temeka Borden chooses to cancel, the client will be refunded a portion of their payment(s), if applicable.

“Portion of Payment(s)” is defined as the total amount of money equaling the remaining number of life coaching sessions that were initially agreed upon and that were paid to the life coach but were not held.

Refund policy

No refund shall be issued after a coaching session. Please see “Cancellation of Coaching Services”, if the client wishes to cancel his/her/their monthly life coaching services plan.

All statements made and opinions expressed by Temeka Borden/Positivity Inspires, LLC during life coaching sessions are those of Temeka Borden and her LLC and do not represent the opinions of any other institutions, businesses, organizations, or individuals (i.e., entities).

Adherence to the Business’s Core Values and Beliefs

Positivity Inspires, LLC/Temeka Borden will adhere to the business’s core values and beliefs. A key core value is to treat others with respect and dignity. Hence, by signing this contract, the client and the life coach agree to be respectful and to not engage in any forms of behavior that would constitute abuse, discrimination, or harassment in any form. Also see the “Anti-discrimination” policy below.

Anti-discrimination Policy

Positivity Inspires, LLC/Temeka Borden is committed to maintaining an environment where all individuals feel welcome and where all individuals feel as though they belong. Hence, Positivity Inspires, LLC/ Temeka Borden does not discriminate based on race, color, ethnicity, ancestry, gender, sexual orientation, religion/religious beliefs, national origin, disability, veteran status, pregnancy status, socioeconomic status, and any (or any other) class defined as a “protected group” by the law.

Services to individuals who reside in countries outside of the US will be considered in the future. However, to ensure this site and business are operating in a compliant manner, services only will be rendered to those who reside in the US at this time.

Confirmations

You (the client) also confirm that you reside in the USA, that you are 18 years of age or older, that you understand everything discussed in this document, and that you are currently in a mental state where you can receive life coaching services.

Please note mental health/counseling services are not provided, as previously stated within this document.

If anything should change regarding your current mental state as it relates to receiving life coaching services and as mentioned earlier, you, the client (or a designated representative), must notify the life coach immediately.
